Terms of Service

The Portal is an optional, AI-assisted convenience tool that reads a home inspection report you provide and reorganizes it into a plain-language summary, categorized items, ballpark cost ranges, a suggested home-maintenance plan, and related general recommendations. It also offers optional features such as a Home Vault for storing your own home documents, a self-guided Energy Efficiency Check, and utility-setup help. It is supplemental guidance only - a convenience layer on top of your inspection report. It is not itself a home inspection, an appraisal, an energy audit, an engineering or contractor evaluation, a warranty, or any other professional service, and it does not replace any of them.

In the State of Texas, home inspections are governed by the Texas Real Estate Commission (TREC) Standards of Practice (22 Texas Administrative Code §§ 535.227-535.233). Your official, TREC-format inspection report - and the licensed inspector who prepared it - are the authoritative source of record for your inspection. A TREC inspection is a limited, visual survey of the general condition of a property at the time of inspection and is not a comprehensive or exhaustive investigation.

Where anything in the Portal differs from, conflicts with, or is not contained in your inspection report, your inspection report governs. Always read and rely on the full inspection report itself.

The Portal uses automated systems and third-party artificial intelligence to read and summarize the report you upload. Automated analysis is probabilistic and can contain errors, omissions, misreadings, miscategorizations, or out-of-date information. Cost figures, tiers, timeframes, and maintenance suggestions are generated heuristically and are not verified by a licensed professional. You are responsible for independently reviewing your inspection report and confirming any item before relying on it. Do not use the Portal where inaccurate output could lead to injury, property damage, or other harm.

The summaries, categories, timeframes, and maintenance suggestions in the Portal are general informational content generated with automated tools. They are not professional advice and do not represent the opinions, recommendations, or advice of your home inspector or of any licensed professional. The Portal does not create an inspector-client, contractor, engineer, attorney, real-estate, financial, or other professional relationship. For decisions about your property, consult the appropriate licensed professionals.

Any repair or replacement costs shown are rough, non-binding ballpark ranges intended only to help you prioritize. They are not quotes, bids, or offers to perform work, and they are not a commitment by Buffalo Property Inspections or any contractor. Actual costs vary widely by contractor, materials, scope, and conditions. Obtain quotes from licensed contractors before making any financial decision.

The Portal may generate a personalized maintenance plan and seasonal or regional suggestions (for example, North Texas items such as foundation watering, HVAC servicing for extreme heat, hard-freeze pipe protection, and hail/roof checks). These are general upkeep reminders, not a guarantee that any task is necessary, sufficient, or appropriate for your specific home. Any self-guided tools, such as the Energy Efficiency Check, produce general, informational estimates based on what you tell us and are not an energy audit, inspection, or professional assessment. You are solely responsible for deciding whether and how to perform any maintenance, and for doing so safely or hiring a qualified professional.

The Portal may include links to third-party partners - for example home-warranty providers, retailers (including Amazon), home-service companies, and utility-setup services. Some of these are affiliate or referral links, and Buffalo Property Inspections may earn a commission if you sign up or purchase through them, at no extra cost to you. These are suggestions for your convenience only and are not endorsements, warranties, or guarantees of any third party or their products, services, pricing, or availability. Your dealings with any third party - including any purchase, enrollment, contract, or dispute - are solely between you and that third party, and Buffalo Property Inspections is not responsible or liable for them.

Electricity and utilities. Texas has a deregulated retail electricity market. Buffalo Property Inspections is not a retail electric provider, broker, or aggregator and does not sell electricity, set rates, or enroll you in any plan. Any electricity links connect you to an independent, registered third-party service that handles plan comparison, required disclosures (such as the Electricity Facts Label), and enrollment. You may also compare plans yourself through the Public Utility Commission of Texas’ official site, Power to Choose.

Referral and affiliate links relate only to routine, general home maintenance and homeownership setup - never to repairs of specific deficiencies identified in your inspection report. Consistent with TREC standards, Buffalo Property Inspections does not accept or receive any commission, fee, or other compensation for referring repairs of items found deficient in an inspection.

Optional, and you're in control. Every referral, affiliate, and partner offer is completely optional - nothing happens unless you choose to click, and many of our partnerships offer discounts to Buffalo Property Inspections clients. We do not sell, rent, or trade your personal information, and we do not share it with a partner to place these offers - your information only reaches a partner if and when you click their link and continue on their site. The Portal may let you generate a shareable, read-only link to your report summary and may deliver content to you by email. If you choose to share a link, you are responsible for who you share it with; anyone who has the link can view that summary without signing in. Do not share links containing information you wish to keep private. The same disclaimers and limitations in these Terms apply to anyone who views shared content.

By creating an account, you consent to receive transactional and service messages from Buffalo Property Inspections (such as sign-in links, one-time sign-in codes, report-ready notices, reminders, and account communications) at the email address you provide, and - if you enable them in the mobile app - push notifications to your device. You can adjust most notification preferences in your account settings; certain essential messages (such as sign-in and security messages) are required to use the Portal.

You must be at least 18 years old and able to form a binding contract to use the Portal. You are responsible for the security of your account and for all activity under it, and for the accuracy of the information and files you provide. You agree not to: upload content you do not have the right to use; upload another person’s report or data without authorization; misuse, probe, scrape, overload, reverse-engineer, or attempt unauthorized access to the Portal; or use the Portal unlawfully or in violation of these Terms. We may suspend or terminate access that violates these Terms or that we reasonably believe is harmful.

You retain ownership of the reports, files, and information you upload - including documents you store in the Home Vault and answers you enter in optional tools (“Your Content”). You grant Buffalo Property Inspections a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, and display Your Content, including by sending it to our service providers and AI provider, solely to operate, provide, secure, and improve the Portal. You represent that you have the rights necessary to grant this license, and you agree not to upload unlawful content or content you do not have the right to store. The Home Vault is a convenience and is not a backup service - please keep your own copies of important documents, as we are not responsible for any loss of files. Our handling of personal information is described in the Privacy Policy.

The Portal is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of accuracy, completeness, reliability, availability, title, non-infringement, merchantability, or fitness for a particular purpose. Buffalo Property Inspections does not warrant that the Portal will be uninterrupted, secure, or error-free, or that any output is accurate or complete. Experiences and outcomes may vary, and we do not guarantee any particular result from using the Portal. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

You acknowledge that you use the Portal voluntarily and at your own risk, and that your sole and authoritative reference remains your TREC inspection report and the advice of licensed professionals. To the fullest extent permitted by law, you release and discharge Buffalo Property Inspections and its owners, members, managers, officers, employees, contractors, and agents (the “Buffalo Property Inspections Parties”) from any claims, demands, or liabilities arising out of or relating to your use of, or reliance on, the Portal or any output it generates.

To the fullest extent permitted by law, the Buffalo Property Inspections Parties will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or property, or for any negative outcomes, decisions, costs, or claims, arising out of or relating to the Portal or these Terms - whether based on contract, tort (including negligence), strict liability, or any other theory, and even if advised of the possibility of such damages.

IN ALL EVENTS, THE TOTAL AGGREGATE LIABILITY OF THE BUFFALO PROPERTY INSPECTIONS PARTIES FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE PORTAL OR THESE TERMS, REGARDLESS OF THE FORM OF ACTION, WILL NOT EXCEED THE LESSER OF (a) THE FEE YOU PAID TO BUFFALO PROPERTY INSPECTIONS FOR THE HOME INSPECTION TO WHICH YOUR USE OF THE PORTAL RELATES, OR (b) ONE HUNDRED U.S. DOLLARS (US$100). The Portal is offered at no additional charge as a convenience supplement to your inspection, and you acknowledge that this cap is reasonable and is a material, bargained-for basis of these Terms, without which the Portal would not be offered. This limitation applies to the fullest extent permitted by law and even if a limited remedy fails of its essential purpose. It does not purport to release Buffalo Property Inspections from liability for its own future gross negligence or willful misconduct where such a release is prohibited by law.

You agree to defend, indemnify, and hold harmless the Buffalo Property Inspections Parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Portal or any output you act on; (b) Your Content or your sharing of it; (c) your dealings with any third-party partner; or (d) your violation of these Terms or of any law or the rights of any third party.

We may update these Terms or modify, suspend, or discontinue any part of the Portal at any time. If we make material changes to these Terms, we will update the “Effective” date above and may provide additional notice. Your continued use of the Portal after an update means you accept the revised Terms.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Before filing any claim, you agree to first contact Buffalo Property Inspections and attempt in good faith to resolve the matter informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction and venue of those courts. Any claim must be brought within one (1) year after it arises, to the extent permitted by law.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND BUFFALO PROPERTY INSPECTIONS EACH WAIVE ANY RIGHT TO A TRIAL BY JURY, AND AGREE THAT ANY DISPUTE WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court on an individual basis only.

These Terms and the Privacy Policy are the entire agreement between you and Buffalo Property Inspections regarding the Portal and supersede any prior understandings. If any provision is held unenforceable, the rest remains in effect, and the unenforceable provision will be enforced to the maximum extent permitted. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them. Buffalo Property Inspections is not liable for any failure or delay caused by events beyond its reasonable control. Section headings are for convenience only.
